In Government of the Lao People’s Democratic Republic v Lao Holdings NV [2024] SGHC(I) 9 the SICC had to decide three issues, i.e. whether (a) the award of costs in the ICSID Award was contrary to public policy in Singapore, (b) the costs decision was a decision on a matter beyond the scope of submission to arbitration, and/or (c) the costs decision was not in accordance with the agreed arbitral procedure.
The SICC denied that there was a valid basis for these claims and rejected the application to set aside an order of court granting the claimant leave to enforce an ICSID award.
